1. Acceptance of These Terms

These Terms of Use (“Terms”) govern your access to and use of pethomegoods.com, including its articles, images, features, forms, and other content or services (collectively, the “Website”).

The Website is owned and operated by 3DK Design LLC, a Florida limited liability company. 3DK Design LLC operates the Website under the Pet Home Goods name. In these Terms, “Pet Home Goods,” “we,” “us,” and “our” refer to 3DK Design LLC.

By accessing or using the Website, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and our Disclaimer. If you do not agree, you must not access or use the Website.

2. Eligibility

WE DO NOT WARRANT THAT THE WEBSITE WILL MEET YOUR REQUIREMENTS, PRODUCE ANY PARTICULAR RESULT, OR OPERATE WITHOUT INTERRUPTION, DELAY, ERROR, LOSS, OR SECURITY INCIDENT.

To the fullest extent permitted by applicable law, the total aggregate liability of 3DK Design LLC for all other claims arising from or related to the Website, its content, or these Terms will not exceed the greater of $100 or the amount you paid directly to 3DK Design LLC for access to the Website during the 12 months preceding the event giving rise to the claim.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited. Your rights may vary by jurisdiction.

15. Indemnification

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless 3DK Design LLC and its owners, officers, employees, contractors, agents, affiliates, licensors, and content providers from claims, liabilities, damages, judgments, losses, and reasonable costs and expenses, including attorneys’ fees, arising from or related to:

  • your unlawful or unauthorized use of the Website;
  • your User Content;
  • your violation of these Terms;
  • your violation of applicable law; or
  • your infringement or violation of another person’s rights.

We may assume control of the defense of a matter subject to indemnification, in which case you agree to cooperate reasonably with that defense. This section does not require you to indemnify 3DK Design LLC for conduct for which indemnification cannot lawfully be required.

  • identification of the copyrighted work;
  • identification and location of the allegedly infringing material;
  • your name and contact information;

18. Governing Law and Disputes

These Terms and any dispute arising from or related to the Website will be governed by the laws of the State of Florida, without regard to conflict-of-law principles.

Before filing a legal proceeding, you and 3DK Design LLC agree to make a good-faith effort to resolve the dispute informally by providing written notice describing the issue and requested resolution and allowing 30 days for a response.

Subject to applicable law, any legal proceeding that is not resolved informally must be brought in a state or federal court having jurisdiction in Broward County, Florida. You and 3DK Design LLC consent to the personal jurisdiction of those courts.

Nothing in this section prevents either party from seeking appropriate relief in small-claims court or immediate injunctive relief to protect intellectual-property rights, confidential information, security, or systems.

19. Severability

If any provision of these Terms is found invalid, unlawful, or unenforceable, that provision will be enforced to the greatest extent permitted, and the remaining provisions will remain in effect.

20. No Waiver

A failure or delay by 3DK Design LLC in enforcing a provision of these Terms does not waive our right to enforce that or any other provision later.

21. Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign or transfer our rights and obligations in connection with a merger, acquisition, sale of assets, reorganization, change in control, or by operation of law, subject to applicable law.

22. Entire Agreement

These Terms, together with the Privacy Policy, Disclaimer, and any additional terms expressly presented for a particular Website feature, constitute the entire agreement between you and 3DK Design LLC concerning your use of the Website.

If additional terms conflict with these Terms, the additional terms will control for the particular feature or activity to which they apply.
